By accessing or using Noise Gradient ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and the operator of the Service.

2. Description of the service

Noise Gradient is a free, browser-based tool for creating gradient backgrounds with optional grain and texture. You may choose from organic, linear, radial, or conic gradient types, customize colors, and export your work as PNG or SVG. No account or signup is required to use the generator or to export content.

The Service is provided free of charge. We do not guarantee uninterrupted, error-free, or secure access. We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice, and we will not be liable to you or any third party for any such change.

3. Your content and exports

You retain all rights in the content you create using the Service and in any works you export (e.g. PNG or SVG files). We do not claim ownership of your designs, and we do not require a license from you to operate the Service. Creation and export are processed in your browser; we do not store or access your gradient settings or exported files unless you voluntarily submit them (for example, via our contact form).

You are solely responsible for ensuring that your use of the Service and any content you create, export, or distribute complies with all applicable laws and does not infringe the intellectual property or other rights of any third party.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not use the Service to create, distribute, or facilitate any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or that infringes any intellectual property or other rights of any person or entity.

You may not attempt to gain unauthorized access to the Service or its systems, interfere with or disrupt the Service or servers or networks connected to it, scrape or harvest data at scale, bypass any rate limits or technical protections, or use automated means (such as bots or scripts) in a manner that places an unreasonable burden on our infrastructure.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected. You assume all risk for your use of the Service and any content you create or export.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE (OR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Indemnification

You agree to indemnify, defend, and hold harmless the operator of the Service and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these terms, or your violation of any law or the rights of a third party.

8. Governing law and disputes

These terms shall be governed by and construed in accordance with the laws of the United States and the state in which the operator is located, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the Service shall be resolved exclusively in the courts of that jurisdiction, and you consent to the personal jurisdiction of such courts.

If any provision of these terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
